Texas food truck license FAQ
Do I still need a city or county health permit?
No. Since July 1, 2026, the DSHS MFV license replaces local mobile food unit health permits, which stopped being effective on that date (DSHS). You still have to follow local fire, location and zoning rules (HSC 437B.101).
How much does a Texas food truck license cost?
Due when you apply: $309 (Type I), $1,018 (Type II) or $1,376 (Type III), including the pre-licensing inspection fee (DSHS). Full fee table.
How long does it take?
The law requires the health inspection within 14 days of a complete application (HSC 437B.054).
Can I operate while I wait?
Only if you held a Texas local MFU/MFV permit and applied with proof of it (Category One). New vendors (Category Two) must pass the inspection first (DSHS).
I have two trucks. One license?
No, you need a separate license for each vehicle (HSC 437B.051). You can list all your vehicles on one application (HSC 437B.053(d)).
Does my license work in every Texas city?
Yes. It's a state license, and local authorities can't prohibit a licensed vendor who complies with non-conflicting state and local law (HSC 437B.051(b)).
Do I need a commissary?
Not if your vehicle passes the DSHS CPF exemption checklist and you dispose of grease and waste properly (HSC 437B.004) (DSHS guide). Details.
Can I use my home kitchen?
No. A private residence can't be a CPF or a servicing area (DSHS guide).
Is there a guide in Spanish?
Yes: Guía para vendedores móviles de alimentos (DSHS).
Who are you?
TX Food Truck License Guide is an independent guide run by Clearline Labs. We are not the Texas Department of State Health Services (DSHS) or any government agency, and we can't issue, speed up or guarantee a license. We are not an insurance agent or agency: we don't sell, solicit or negotiate insurance or give coverage advice. If we link to or refer you to a business, we may be paid a flat referral fee that does not depend on whether you buy anything.
